Terms of Service

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE CAMP CARD APPLICATION OR WEBSITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE AND SHOULD IMMEDIATELY DELETE THE APP FROM YOUR DEVICE. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SECTION 14) THAT AFFECT YOUR LEGAL RIGHTS.

Welcome to Camp Card. These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("you," "your," "User") and Swipe Savvy, LLC ("Swipe Savvy," "Company," "we," "us," or "our"), governing your access to and use of the Camp Card mobile application, the website at https://www.campcardapp.org, and all related services (collectively, the "Service").

Camp Card is developed and operated by Swipe Savvy, LLC in partnership with Scouting America to support Scout fundraising programs through digital discount offers, merchant partnerships, and subscription-based services.

1. Acceptance of Terms

By creating an account, downloading, installing, accessing, or using Camp Card in any manner, you agree to be bound by these Terms, our Privacy Policy, and any additional terms, guidelines, or rules referenced herein. These Terms form a binding legal contract between you and Swipe Savvy, LLC.

Camp Card is developed and published by Swipe Savvy, LLC in collaboration with Scouting America to digitalize and modernize Scout fundraising efforts. Scouting America has authorized the use of its trademarks and branding within the Camp Card platform in connection with official Scout fundraising programs.

If you are using the Service on behalf of an organization (such as a Scouting America council, troop, or pack), you represent and warrant that you have the authority to bind that organization to these Terms, and the terms "you" and "your" will refer to that organization.

Your continued use of the Service following the posting of any changes to these Terms constitutes your acceptance of such changes. If you do not agree with any modifications, you must discontinue use of the Service immediately.

2. Description of Service

Camp Card is a digital platform designed to support Scouting America fundraising through a mobile application, web portal, and related services. The Service provides the following core features:

Subscription Management Purchase and manage Camp Card subscriptions for access to the full offer catalog
Scout Fundraising Support Tools for Scouts, troop leaders, and councils to track fundraising progress, manage troops, and generate referral links
Gift Cards Purchase Camp Card subscriptions as gifts for others, redeemable via unique claim codes

Camp Card is currently available for use in the United States only. The Service is designed to support Scouting America councils and troops operating within the United States. We do not guarantee availability, functionality, or compliance with laws outside the United States. By accessing the Service from outside the US, you do so at your own risk and are responsible for compliance with local laws.

We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. Eligibility

3.1 Age Requirements

To create an account and use Camp Card, you must meet the following age requirements:

  • Minimum Age: You must be at least 13 years of age to create a Camp Card account. We do not knowingly collect personal information from children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA).
  • Minors (Ages 13-17): If you are under 18 years of age, you must obtain verifiable parental or legal guardian consent before creating an account or using the Service. A parent or guardian must review and agree to these Terms on your behalf. Parents or guardians who consent to their child's use of the Service are responsible for monitoring that child's activity and are bound by these Terms with respect to the child's use.
  • Adults (18+): If you are 18 years of age or older, you represent and warrant that you have the legal capacity to enter into these Terms.

3.2 Account Requirements

To use certain features of the Service, you must:

  • Provide accurate, current, and complete registration information
  • Be a legal resident of the United States or its territories
  • Not have been previously suspended, removed, or banned from the Service
  • Not use the Service for any unlawful purpose or in violation of these Terms
  • Have a valid email address capable of receiving communications from us
  • Not impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity

4. Account Registration and Security

4.1 Account Creation

To access the full features of Camp Card, you must create an account by providing the following information:

  • Full legal name (first and last name)
  • Valid email address
  • Secure password meeting our minimum security requirements
  • User role (Scout, Parent, Troop Leader, or as assigned by your organization)
  • Council and/or troop affiliation (if applicable)

You represent and warrant that all information provided during registration is accurate, truthful, and complete. You agree to promptly update your account information to keep it current. Providing false or misleading information may result in immediate suspension or termination of your account.

4.2 Account Security

You are responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account. You agree to:

  • Create a strong, unique password that you do not use for other services
  • Not share your login credentials with any other person
  • Immediately notify us at support@swipesavvy.com if you suspect any unauthorized access to or use of your account
  • Log out of your account at the end of each session, especially on shared devices
  • Not attempt to access another user's account without authorization

Swipe Savvy will never ask you for your password via email, phone, or any other communication channel. We shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.

4.3 Account Types

Camp Card supports the following account types, each with different access levels, features, and responsibilities:

Your account type determines the features and data available to you. You agree to use your account only for its intended purpose and within the scope of your assigned role. Attempting to access features or data beyond your authorized role is a violation of these Terms.

5. Subscriptions and Payments

5.1 Subscription Plans

Camp Card offers subscription-based access to its platform. Subscription plans, pricing, features, and availability may vary by Scouting America council, region, and promotional period. Current subscription plans and pricing are displayed within the App and on our website at the time of purchase.

By subscribing, you agree to pay the applicable subscription fee and any associated taxes. The specific terms of your subscription, including duration and features, are presented to you at the time of purchase and form part of this Agreement.

5.2 Payment Processing

All payments for Camp Card subscriptions and services are processed through Authorize.net, a leading PCI-DSS Level 1 compliant payment gateway. When you make a purchase:

  • Your payment information (credit card, debit card) is securely transmitted to and processed by Authorize.net
  • Swipe Savvy does not store your full credit card number, CVV, or other sensitive payment card data on our servers
  • Authorize.net tokenizes your payment information for secure recurring billing
  • All payment transactions are encrypted using industry-standard TLS encryption
  • By providing your payment information, you authorize Swipe Savvy and Authorize.net to charge the applicable fees to your designated payment method

Payment processing is subject to the terms and conditions of Authorize.net. By making a payment, you also agree to Authorize.net's terms of service and privacy policy. Swipe Savvy is not responsible for any errors, delays, or issues caused by Authorize.net or your financial institution.

5.3 Billing and Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You agree to the following billing terms:

  • Auto-Renewal: Your subscription will automatically renew for the same duration and at the then-current price unless you cancel prior to the renewal date
  • Renewal Notifications: We will send you a reminder notification via email and/or push notification at least 7 days before your subscription renewal date
  • Billing Date: You will be billed on the same calendar date as your original subscription purchase, or the last day of the month if no corresponding date exists
  • Failed Payments: If a payment fails, we may attempt to process the payment again. If payment cannot be collected after reasonable attempts, your subscription may be suspended or terminated
  • Cancellation: You may cancel auto-renewal at any time through the App, website, or by contacting support@swipesavvy.com. Cancellation takes effect at the end of the current billing period; you will retain access until that time

5.4 Refund Policy

Our refund policy is as follows:

  • 30-Day Guarantee: If you are not satisfied with your subscription, you may request a full refund within 30 days of your initial purchase. This guarantee applies to first-time purchases only
  • Prorated Refunds: After the initial 30-day period, refund requests may be considered on a prorated basis at our sole discretion, based on the unused portion of your subscription
  • Discretionary Refunds: All refund requests beyond the 30-day guarantee period are evaluated at Swipe Savvy's sole discretion. We are not obligated to issue refunds outside the 30-day window
  • No Refunds For: Refunds will not be issued for partial months of service, accounts terminated for violation of these Terms, or subscription periods where the Service was available but you chose not to use it
  • How to Request: To request a refund, contact support@swipesavvy.com with your account email, subscription details, and reason for the request. Refunds are processed to the original payment method within 5-10 business days

5.5 Price Changes

Swipe Savvy reserves the right to change subscription pricing at any time. If we change the price of your subscription plan:

  • We will provide at least 30 days' advance notice via email and/or in-app notification before the new price takes effect
  • The new price will apply at the start of your next billing cycle after the notice period
  • If you do not agree to the price change, you may cancel your subscription before the new price takes effect
  • Continued use of the Service after the price change constitutes acceptance of the new pricing

5.6 Gift Card Terms

Camp Card gift cards ("Gift Cards") allow the purchase of Camp Card subscriptions for others. Gift Card terms include:

  • Gift Cards are redeemable only for Camp Card subscriptions and cannot be exchanged for cash, except as required by law
  • Gift Cards are non-transferable after issuance, except to the intended recipient
  • Gift Cards do not expire, unless otherwise required or permitted by applicable law
  • Gift Cards are redeemed using a unique claim code provided at the time of purchase
  • Lost or stolen Gift Cards will not be replaced unless proof of purchase is provided
  • Swipe Savvy is not responsible for lost, stolen, or unauthorized use of Gift Cards
  • We reserve the right to void Gift Cards obtained through fraud or in violation of these Terms

6. Scout Data and Fundraising

This section addresses how Scout data is used within the Camp Card platform. Protecting the privacy and interests of Scouts is a core principle of our Service.

Camp Card collects and processes certain information about Scouts participating in Scouting America fundraising programs. We are committed to responsible and limited use of Scout data in accordance with the following principles:

  • Fundraising Purpose Only: Scout information collected through Camp Card, including names, troop affiliations, council associations, referral codes, and sales activity, is used solely for the purposes of fundraising reporting and sales tracking in connection with Scouting America Camp Card fundraising programs
  • No Marketing or Advertising: Scout data will not be used for marketing, advertising, behavioral profiling, or any purpose unrelated to Scouting America fundraising activities. We do not target Scouts with advertisements or promotional content based on their personal data
  • No Profiling: We do not create behavioral profiles of Scouts for commercial purposes. Analytics related to Scout activity are limited to fundraising performance metrics (e.g., total sales, referral counts, redemption statistics)
  • Limited Data Sharing: Scouting America councils and troop leaders receive only reporting and sales tracking data necessary for managing their fundraising programs. This includes aggregate and individual fundraising performance metrics such as subscription sales, referral activity, and offer redemptions attributable to their troop or council
  • Council and Troop Leader Access: Council Admins and Troop Leaders may access fundraising data for Scouts within their respective organizations for the sole purpose of managing, tracking, and reporting on fundraising activities. They may not use this data for any other purpose
  • Data Minimization: We collect only the minimum amount of Scout data necessary to support the fundraising features of the Service
  • Parental Oversight: Parents and legal guardians have the right to access, review, and request deletion of their child's data as described in our Privacy Policy and in accordance with COPPA requirements

Scout data shared with Scouting America councils and troop leaders is provided under the obligation that such data will be used exclusively for fundraising reporting and sales tracking purposes. Any misuse of Scout data by council administrators or troop leaders is a violation of these Terms.

7. User Conduct

7.1 Acceptable Use

You agree not to use the Service for any purpose that is unlawful, harmful, or otherwise objectionable. Specifically, you agree not to:

  • Violate any applicable local, state, national, or international law or regulation
  • Use the Service for any fraudulent, deceptive, or misleading purpose
  • Create false or misleading accounts, or impersonate any person or entity
  • Share, distribute, or transfer your account credentials or subscription access to unauthorized users
  • Attempt to circumvent, disable, or interfere with any security features of the Service
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Use automated scripts, bots, scrapers, or similar tools to access or collect data from the Service
  • Interfere with or disrupt the integrity, performance, or availability of the Service or its servers
  • Upload, transmit, or distribute viruses, malware, or other harmful code
  • Harass, abuse, threaten, or intimidate other users of the Service
  • Collect or harvest personal information of other users without their consent
  • Use the Service to send unsolicited commercial messages (spam)
  • Reproduce, duplicate, sell, or resell any portion of the Service without express written permission
  • Abuse the referral system by creating fake accounts or generating fraudulent referrals
  • Misrepresent your affiliation with Scouting America, any council, troop, or Swipe Savvy

7.2 Offer Redemption

When redeeming offers through Camp Card, you agree to:

  • Present a valid, active Camp Card subscription at the time of redemption
  • Use offers only as intended and in accordance with the specific terms displayed for each offer
  • Redeem offers only at participating merchant locations during their stated validity period
  • Not attempt to redeem offers that have expired, been revoked, or are otherwise inactive
  • Not duplicate, screenshot, or forge QR codes or offer redemption credentials
  • Respect any per-user, per-day, or per-transaction redemption limits set by merchants or Swipe Savvy
  • Understand that offers are subject to availability and may be modified or withdrawn by the merchant or Swipe Savvy at any time without notice
  • Acknowledge that Swipe Savvy is not the provider of the goods or services offered by merchants and is not responsible for the quality, safety, or fulfillment of merchant offers

7.3 Reporting Violations

If you become aware of any violation of these Terms, misuse of the Service, or any fraudulent activity, you agree to promptly report it to us at support@swipesavvy.com. We take reports seriously and will investigate all credible reports of violations. You may also report violations in-app through the designated reporting features.

8. Intellectual Property

8.1 Our Intellectual Property

The Service, including the Camp Card application, website, and all content, features, functionality, software, code, designs, text, graphics, logos, icons, images, audio, video, data compilations, and the arrangement thereof (collectively, "Our Content"), is owned by Swipe Savvy, LLC, its licensors, or other providers of such material and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8.2 Limited License

Subject to your compliance with these Terms, Swipe Savvy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

  • Download and install the App on your personal mobile device
  • Access and use the Service for your personal, non-commercial use in connection with Scouting America fundraising activities
  • View and interact with content made available through the Service

This license does not include any right to modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download (other than page caching), store, or transmit any of Our Content except as expressly permitted by these Terms or with our prior written consent.

8.3 Restrictions

You may not:

  • Copy, modify, or distribute the App or any portion thereof
  • Reverse engineer, decompile, or disassemble the App or attempt to discover its source code
  • Make the App available over a network where it could be used by multiple devices simultaneously (unless authorized)
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices
  • Use the Service for any commercial purpose not authorized by Swipe Savvy
  • Sublicense, lease, rent, loan, or otherwise transfer the App or your access to any third party
  • Use any data mining, robots, or similar data-gathering methods in connection with the Service

8.4 Scouting America Trademarks

The Scouting America name, logo, insignia, and related trademarks and service marks are the property of Scouting America and are used under license by Swipe Savvy, LLC. You may not use any Scouting America trademarks without the prior written consent of Scouting America. Nothing in these Terms grants you any right, title, or interest in Scouting America trademarks.

8.5 User Content

To the extent the Service allows you to submit, post, or transmit content (such as profile information, feedback, or reviews), you retain ownership of your content but grant Swipe Savvy a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, display, and distribute such content in connection with operating and improving the Service. You represent and warrant that you own or have the necessary rights to submit such content and that it does not violate the rights of any third party.

9. Third-Party Services

9.1 Merchant Relationships

Camp Card facilitates connections between users and participating merchants, but Swipe Savvy is not a party to any transaction between you and a merchant. Specifically:

  • Swipe Savvy does not own, operate, or control participating merchant businesses
  • We do not guarantee the quality, safety, legality, or availability of merchant goods or services
  • We are not responsible for the accuracy of merchant information, pricing, or offer details displayed in the App
  • Any disputes between you and a merchant must be resolved directly between you and the merchant
  • Merchants may modify, limit, or discontinue their participation in Camp Card at any time
  • The inclusion of a merchant in the Service does not constitute an endorsement, recommendation, or guarantee by Swipe Savvy or Scouting America

Swipe Savvy acts solely as a platform connecting subscribers with merchant offers. We are not responsible for any loss, injury, or damage arising from your interactions with participating merchants.

9.2 Third-Party Links

The Service may contain links to third-party websites, applications, or services that are not owned or controlled by Swipe Savvy. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Swipe Savvy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available through any third-party websites or services.

9.3 Payment Processors

Camp Card uses Authorize.net as its exclusive payment processing provider. Authorize.net is a Visa subsidiary and PCI-DSS Level 1 compliant payment gateway. By using payment features of the Service:

  • You agree to comply with Authorize.net's terms of service, acceptable use policies, and privacy policy
  • You acknowledge that your payment data is transmitted directly to Authorize.net for processing
  • Swipe Savvy does not store or have access to your full payment card details
  • Authorize.net's availability, performance, and security are outside of Swipe Savvy's control
  • Any issues related to payment processing, chargebacks, or transaction disputes may involve coordination with Authorize.net and/or your financial institution

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, Swipe Savvy expressly disclaims any and all warranties regarding:

  • Savings and Discounts: We do not guarantee the amount of savings, the availability of any specific discount, or the accuracy of any stated discount percentage or value
  • Merchant Availability: We do not guarantee that any particular merchant will continue to participate in the Service or honor listed offers at any time
  • Service Uptime: We do not guarantee uninterrupted, timely, secure, or error-free operation of the Service. The Service may be subject to scheduled or unscheduled downtime, maintenance, or interruptions
  • Accuracy: We do not warrant that any information provided through the Service is accurate, complete, reliable, current, or error-free
  • Results: We do not guarantee any specific fundraising results, sales figures, or outcomes from using the Service
  • Compatibility: We do not guarantee that the Service will be compatible with all devices, operating systems, or network configurations
  • Third-Party Services: We do not warrant the performance, availability, or reliability of any third-party services integrated with or linked from the Service

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, the warranties are limited to the minimum extent permitted by applicable law.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SWIPE SAVVY, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER SWIPE SAVVY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the foregoing, this limitation applies to, but is not limited to, damages arising from:

  • Your use of or inability to use the Service
  • Unauthorized access to or alteration of your data or account
  • Loss of data, content, or information
  • Statements or conduct of any third party on or through the Service
  • Merchant interactions, offer redemptions, or the quality of merchant goods and services
  • Payment processing errors or delays
  • Service interruptions, downtime, or outages
  • Any other matter related to the Service

IN NO EVENT SHALL SWIPE SAVVY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS YOU HAVE PAID TO SWIPE SAVVY IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Essential Purpose: The limitations of liability set forth in this section shall apply even if any limited remedy provided herein is found to have failed of its essential purpose. The parties acknowledge that the limitations of liability reflect an informed, voluntary allocation of risk and are a fundamental element of the basis of the bargain between the parties.

Jurisdictional Limitations: Some jurisdictions do not allow the limitation or exclusion of liability for incidental, consequential, or certain other types of damages. If you reside in such a jurisdiction, the above limitations or exclusions may not apply to you, and the limitations shall be applied to the fullest extent permitted by applicable law in your jurisdiction.

12. Indemnification

You agree to indemnify, defend, and hold harmless Swipe Savvy, LLC, Scouting America, their respective Scouting America councils, and each of their respective affiliates, officers, directors, employees, agents, licensors, service providers, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, damages, losses, liabilities, obligations, penalties, fees, costs, and expenses (including reasonable attorneys' fees and legal costs) arising from or related to:

  • Your use of or access to the Service
  • Your violation of these Terms or any applicable law or regulation
  • Your violation of any rights of a third party, including intellectual property, privacy, or publicity rights
  • Any content you submit, post, or transmit through the Service
  • Your fraudulent or deceptive conduct
  • Your negligence or willful misconduct
  • Any dispute between you and a participating merchant

Swipe Savvy reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate fully with our defense of such claims. You agree not to settle any matter without our prior written consent. We will use reasonable efforts to notify you of any such claim upon becoming aware of it.

13. Termination

13.1 Termination by You

You may terminate your account and stop using the Service at any time by:

  • Deleting your account through the App or website settings
  • Contacting us at support@swipesavvy.com to request account deletion
  • Uninstalling the App from your device (note: this alone does not delete your account or cancel your subscription)

Termination of your account does not automatically entitle you to a refund of any prepaid subscription fees. See Section 5.4 for our refund policy.

13.2 Termination by Us

Swipe Savvy reserves the right to suspend, restrict, or terminate your account and access to the Service, in whole or in part, at any time and for any reason, with or without notice, including but not limited to:

  • Violation of these Terms or any applicable law or regulation
  • Fraudulent, abusive, or illegal activity
  • Non-payment of subscription fees or chargebacks
  • Requests from law enforcement or other government agencies
  • Extended periods of inactivity
  • Unexpected technical or security issues
  • Discontinuation of the Service or any part thereof
  • Conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the business interests of Swipe Savvy or Scouting America

13.3 Effect of Termination

Upon termination of your account for any reason:

  • Your right to access and use the Service will immediately cease
  • Your license under Section 8.2 will automatically terminate
  • All pending or unused offers, discounts, and subscription benefits will be forfeited
  • You must delete all copies of the App from your devices
  • We may retain your data as described in our Privacy Policy and as required by applicable law
  • Outstanding payment obligations and any amounts owed to Swipe Savvy shall survive termination

13.4 Survival

The following sections shall survive termination or expiration of these Terms: Section 5 (to the extent of outstanding payment obligations), Section 6, Section 8 (Intellectual Property), Section 10 (Disclaimer of Warranties), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 13.3 (Effect of Termination), Section 13.4 (Survival), Section 14 (Dispute Resolution), Section 15 (Privacy), Section 19 (General Provisions), Section 20 (Apple App Store Terms), and Section 21 (Google Play Store Terms).

14. Dispute Resolution

THIS SECTION CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER. PLEASE READ IT CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

14.1 Informal Resolution

Before initiating any formal dispute resolution proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") informally by contacting us at legal@swipesavvy.com. You must include your name, account email, a detailed description of the Dispute, and the specific relief sought. We will attempt to resolve the Dispute within 60 days of receipt of your notice. If the Dispute is not resolved within 60 days, either party may proceed to arbitration as described below.

14.2 Binding Arbitration

If the Dispute cannot be resolved through the informal process described above, you and Swipe Savvy agree that the Dispute shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association ("AAA") in accordance with the AAA's Consumer Arbitration Rules then in effect, as modified by this section.

  • The arbitration shall be conducted by a single neutral arbitrator selected in accordance with the AAA rules
  • The arbitration shall take place in the State of Texas, or at another location mutually agreed upon by the parties, or by telephone or video conference if the amount in controversy is less than $25,000
  • The arbitrator shall apply the substantive law of the State of Texas, without regard to its conflict of laws principles
  • The arbitrator shall have the authority to award any remedies that would be available in a court of competent jurisdiction
  • The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction
  • Each party shall bear its own attorneys' fees and costs, unless the arbitrator determines that a claim was frivolous, in which case the losing party shall pay the prevailing party's reasonable attorneys' fees
  • If the AAA is unavailable, the parties shall mutually agree on an alternative arbitration forum. If they cannot agree, either party may petition a court of competent jurisdiction to appoint an arbitrator

14.3 Class Action Waiver

YOU AND SWIPE SAVVY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. UNLESS BOTH YOU AND SWIPE SAVVY AGREE OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration agreement shall be null and void, and the Dispute shall be resolved exclusively in the courts described in Section 14.6.

14.4 Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual action in small claims court for Disputes within the jurisdictional limits of such court. If the Dispute is removed or transferred from small claims court, it shall be subject to binding arbitration as described above.

14.5 Opt-Out

You may opt out of the binding arbitration and class action waiver provisions of this section by sending written notice to legal@swipesavvy.com within 30 days of the date you first accept these Terms. Your notice must include your full name, account email address, mailing address, and a clear statement that you wish to opt out of the arbitration and class action waiver provisions. If you timely opt out, neither party shall be bound by this arbitration agreement, and Disputes will be resolved in the courts described in Section 14.6. Opting out does not affect any other provisions of these Terms.

14.6 Governing Law

These Terms and any Disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law provisions. To the extent that litigation is permitted (including if you have opted out of arbitration), you and Swipe Savvy agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in the State of Texas.

15. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, process, disclose, and safeguard your information when you use the Service. The Privacy Policy is incorporated by reference into these Terms and forms part of this Agreement.

By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. We encourage you to review the Privacy Policy carefully before using the Service and periodically thereafter for any changes.

If there is a conflict between these Terms and the Privacy Policy, the Privacy Policy shall control with respect to matters relating to privacy and data protection, and these Terms shall control with respect to all other matters.

16. COPPA Compliance

Camp Card is committed to protecting the privacy and safety of children in compliance with the Children's Online Privacy Protection Act (COPPA).

The Children's Online Privacy Protection Act of 1998 ("COPPA") requires that we obtain verifiable parental consent before collecting personal information from children under 13. Our COPPA compliance measures include:

  • Minimum Age: Users must be at least 13 years of age to create a Camp Card account. We do not knowingly collect personal information from children under the age of 13
  • Parental Consent: For users between 13 and 17 years of age, verifiable parental or guardian consent is required before account creation and use of the Service. We may implement consent verification mechanisms such as email confirmation, consent forms, or other methods permitted under COPPA
  • Age Restrictions: If we learn that we have inadvertently collected personal information from a child under 13 without proper parental consent, we will take immediate steps to delete such information from our systems
  • Parental Rights: Parents and legal guardians have the following rights regarding their child's data:
    • Right to review all personal information collected from their child
    • Right to request deletion of their child's personal information
    • Right to refuse further collection or use of their child's information
    • Right to consent to the collection and use of their child's information without consenting to disclosure to third parties (where applicable)
  • Data Collection Limits: We limit the personal information collected from minor users to what is reasonably necessary for participation in Scouting America fundraising activities through Camp Card
  • No Conditioning: We do not condition a child's participation in the Service on the child providing more personal information than is reasonably necessary

17. Electronic Communications

By creating an account and using Camp Card, you consent to receive electronic communications from Swipe Savvy, including but not limited to:

  • Account Notifications: Registration confirmations, password resets, security alerts, and account updates
  • Subscription Communications: Billing confirmations, renewal reminders, payment receipts, and subscription status changes
  • Service Updates: New features, maintenance notifications, service changes, and App updates
  • Fundraising Communications: Fundraising progress updates, troop activity summaries, and campaign notifications
  • Legal Notices: Updates to these Terms, the Privacy Policy, and other legal documents

You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. Electronic communications may be sent via email, push notifications, in-app messages, or through the Service.

You may manage your communication preferences through the App's notification settings or by contacting support@swipesavvy.com. Please note that certain communications (such as account security alerts, billing notices, and legal updates) are transactional in nature and cannot be opted out of while your account remains active.

18. Changes to Terms

Swipe Savvy reserves the right to modify, amend, or update these Terms at any time and at our sole discretion. When we make changes:

  • Posting: Updated Terms will be posted on our website at https://www.campcardapp.org/terms/ and within the App. The "Last Updated" date at the top of these Terms will be revised accordingly
  • Notification: For material changes, we will provide notice through one or more of the following methods: email notification to the address associated with your account, in-app notification or banner, push notification (if enabled), or prominent notice on our website
  • Effective Date: Changes will be effective upon posting unless otherwise stated. For material changes, we will provide at least 15 days' notice before the changes take effect
  • Continued Use: Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account in accordance with Section 13.1

We encourage you to periodically review these Terms to stay informed of any changes. It is your responsibility to review the Terms for any modifications.

19. General Provisions

19.1 Entire Agreement

These Terms, together with the Privacy Policy and any other legal documents or policies referenced herein, constitute the entire agreement between you and Swipe Savvy regarding your use of the Service. These Terms supersede all prior and contemporaneous agreements, understandings, representations, and warranties, both written and oral, regarding the Service.

19.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the invalidity of that provision shall not affect the validity of the remaining provisions, which shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

19.3 Waiver

The failure of Swipe Savvy to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any term or condition of these Terms shall be effective only if made in writing and signed by an authorized representative of Swipe Savvy. Any waiver shall apply only to the specific instance and shall not be deemed a continuing or future waiver of such term or condition or any other term or condition.

19.4 Assignment

You may not assign, delegate, or transfer these Terms or any of your rights or obligations hereunder without the prior written consent of Swipe Savvy. Swipe Savvy may assign these Terms, in whole or in part, at any time without your consent, including in connection with a merger, acquisition, corporate reorganization, sale of all or substantially all of its assets, or any similar transaction. Subject to the foregoing, these Terms shall be binding upon and inure to the benefit of the parties and their respective successors and assigns.

19.5 Force Majeure

Swipe Savvy shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, fire, flood, earthquake, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, government actions, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers. In the event of a force majeure event, Swipe Savvy's obligations shall be suspended for the duration of the event, and Swipe Savvy shall use reasonable efforts to resume performance as soon as practicable.

19.6 Headings

The section headings used in these Terms are for convenience of reference only and shall not affect the interpretation or construction of these Terms.

19.7 No Third-Party Beneficiaries

These Terms are intended solely for the benefit of the parties hereto and do not confer any rights or remedies upon any third party, with the following exceptions:

  • Apple Inc.: Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to users who access the Service through the Apple App Store. Upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof (see Section 20)
  • Google LLC: Google and its subsidiaries are third-party beneficiaries of these Terms with respect to users who access the Service through the Google Play Store. Upon your acceptance of these Terms, Google has the right to enforce these Terms against you as a third-party beneficiary thereof (see Section 21)

20. Apple App Store Terms

The following additional terms apply if you download or use the Camp Card application through the Apple App Store:

  • These Terms are between you and Swipe Savvy, LLC only, and not with Apple Inc. ("Apple"). Swipe Savvy, not Apple, is solely responsible for the App and its content
  • The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions
  • Swipe Savvy, not Apple, is responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if applicable). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App
  • Swipe Savvy, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation
  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Swipe Savvy, not Apple, shall be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim
  • You represent and warrant that (a) you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a "terrorist supporting" country; and (b) you are not listed on any US Government list of prohibited or restricted parties
  • Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof
  • You must comply with all applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement)

21. Google Play Store Terms

The following additional terms apply if you download or use the Camp Card application through the Google Play Store:

  • These Terms are between you and Swipe Savvy, LLC only, and not with Google LLC ("Google") or any of its affiliates. Swipe Savvy, not Google, is solely responsible for the App and its content
  • Your use of the App must comply with Google Play's current Terms of Service
  • Google is only a provider of the Google Play Store where you obtained the App. Google has no obligation or liability to you with respect to the App or these Terms
  • Swipe Savvy, not Google, is solely responsible for providing any maintenance, support, and warranty services with respect to the App, as specified in these Terms or as required under applicable law
  • Swipe Savvy, not Google, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation
  • In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Swipe Savvy, not Google, shall be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim
  • Google and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Google will have the right to enforce these Terms against you as a third-party beneficiary thereof
  • You must comply with all applicable Google Play Store policies and developer guidelines when using the App
